Are you new to AI? If you are not, you’re probably one of those old school people who don’t have a smart phone or a social media account or even a smart TV. Or maybe you’re just not that interested in AI to even want to be in the know.
For those of us who live, eat and breathe technology, all eyes are on the executive order on AI and what it means to businesses, innovation and the American people. 2023 was the year of AI and 2024 maybe the year of lawsuits.
In order to combat what can be harmful development and or launching of AI tools that do not better the lives of the user, the government stepped in with an executive order.
I get it. AI and politics don’t mix and not every one is going to care. But humor me and let’s discuss.
What is an executive order?
A presidential executive order is a directive issued by the President of the United States that manages operations of the federal government.
Executive orders have the force of law. They are used by the President to manage the operations of the federal government, implement laws passed by Congress, or address specific issues and policies.
While they are powerful tools, executive orders must still comply with the Constitution and existing laws. They are typically published in the Federal Register and can be subject to legal review and potential challenges.
Why is an AI executive order Important?
The term “presidential executive order” is important because it represents a significant authority granted to the President of the United States as well as the administer the executive branch of the federal government to manage.
Here are some reasons why it is important:
- Executive Authority: Executive orders allow the President to efficiently and directly manage the executive branch. They serve as a means for the President to implement and enforce laws passed by Congress.
- Quick Action: In certain situations, where prompt action is needed, executive orders enable the President to take swift measures without waiting for legislative approval.
- Policy Implementation: Presidents use executive orders to set and implement policies that align with their agenda and priorities, helping to shape the direction of government actions.
However, there are some potential flaws or concerns associated with the use of executive orders:
- Concentration of Power: Critics argue that reliance on executive orders may concentrate too much power in the hands of the President, potentially undermining the system of checks and balances.
- Limited Transparency: Some executive orders are issued without extensive public input or congressional debate, leading to concerns about transparency and accountability in the decision-making process.
- Legal Challenges: Executive orders can face legal challenges if they are perceived to exceed the President’s constitutional authority or if they conflict with existing laws. Courts may strike down or modify executive orders deemed unconstitutional.
- Limited Scope: While executive orders can direct the actions of the executive branch, they cannot create new laws or appropriate funds. Those responsibilities are powers reserved for Congress. This limitation can affect the long-term impact of certain policy directives.
While executive orders play a crucial role in presidential governance, there are ongoing debates about their appropriate use, its potential for abuse, and the need to balance executive authority with constitutional checks and balances.
How an executive order on AI will impact tech industry.
The impact of a presidential executive order on the technology industry can vary depending on the specific content and goals of the order. Here are some ways in which a presidential executive order can influence the technology sector. For example:
- Regulation and Compliance: Executive orders can introduce new regulations or modify existing ones related to the technology industry. It can include issues such as data privacy, cybersecurity standards, or competition regulations. Companies in the technology sector may need to adapt their practices to comply with these regulations.
- National Security Concerns: Executive orders may address national security concerns related to technology, especially in areas such as telecommunications and critical infrastructure. The order could outline measures to protect against cyber threats or address supply chain vulnerabilities.
- Trade and International Relations: If the executive order has implications for international trade or cooperation in the technology sector. It can impact companies that operate globally. This may involve issues like trade tariffs, export controls, or collaborations with foreign entities.
- Research and Development Funding: Executive orders can influence government funding for technology-related research and development initiatives. The order may prioritize certain areas of technology, such as artificial intelligence, renewable energy, or advanced manufacturing.
- Antitrust and Competition Policies: The government may use executive orders to address concerns related to antitrust and competition in the technology industry. This could impact the market dominance of certain companies and influence competition policies.
- Immigration Policies: Changes in immigration policies through executive orders may impact the technology industry’s workforce, especially if the order affects the ability of tech companies to hire skilled workers from other countries.
- Environmental Policies: Executive orders addressing environmental issues could impact technology companies involved in manufacturing, energy consumption, or electronic waste. Requirements for sustainable practices may be outlined in such orders.
Furthermore important to note that the specific impact on the technology industry will depend on the details of the executive order and how it is implemented. Additionally, executive orders can be subject to legal challenges, and their long-term effects may be shaped by subsequent legislative actions and regulatory developments.
Overall the AI executive order is laying down the foundation for future constitutional rights violation that is directly a result of technology. It should initially start conversation with all stakeholders to minimize said impact but as we know the courts move way slower than the development of any technology.
With that being said, the American population should be protected from any intentional or unintentional use of AI.
We’ll keep an eye out on the market and bring you updates as they develop.
